Allegation

On July 17, 2022, at approximately 0244 hours, Officer Richard Edmonds made an unlawful arrest for an ordinance violation. Subsequent to releasing the subject on a Notice to Appear citation, a second unlawful arrest of the same subject was made for disorderly intoxication and resisting arrest without violence. The appropriate general order for the allegations involving Officer Edmonds are as follows: not limited to: failure to take appropriate action on the occasion of a crime scene, disorder or other act or condition deserving attention. (Level 3)

Improper Searches/Arrests (212.57) - No employee shall make an improper search or seizure or an arrest or detention not in accordance with current department directives. Employees shall respect the constitutional and civil rights of all arrested or detained persons. (Level 4) – 2 violations

Duty to Read/Understand/Comply with Orders (212.05) - Employees shall read, understand, and comply with all rules and regulations, general orders, administrative orders, policies and procedures of the Department, written and verbal orders of a superior. To this end, it shall be considered to be the employees duty to inquire of a superior until the matter is resolved concerning any question as to the meaning or application of any law, rule or regulation, general or administrative order, policy or procedure, written or verbal order. (Level 2) to wit:

Body Worn Camera (447.7) - Criteria for Activation:

A. Unless unsafe, impossible, or impractical to do so, all members wearing a B.W.C. shall activate their B.W.C prior to arriving at a call for service involving contact with the public or any situation that may reasonably result in law enforcement action, such as: Conducting a traffic stop; an F.I.R. type citizen encounter; making or anticipating making an arrest; interaction with a confrontational subject; Code-3 operation; conducting a search; collecting or counting currency; etc.

Restrictions 447.9 (B) - Except as permitted by this policy, members will not intentionally disengage, interrupt, or mute a recording at any time the B.W.C. is required to be on. This includes placing a hand or item over the B.W.C. to obstruct the B.W.C. optic or microphone.

Disposition

Based on the facts documented in the administrative investigation, the Discipline Review Board sustained the allegations against Officer Edmonds.

Discipline/Corrective Action

In accordance with progressive discipline guidelines, Officer Edmonds received a 6-day suspension.
